Terms of Use

Basics

The terms of use set out below are applicable to any individual who is submitting a payment or payments using the payment administration system provided by us (the "Payment System");  and/or any individual who has agreed to submit additional personal data via the site in order that we may provide the Recipient with compliance and anti-money laundering checks (“Compliance Checks”) and/or information regarding eligibility for a claim (“Triaging Information”) ("you"). 

The terms of use provide details of the terms governing your use of the Payment System, and/or submission of information via the site in order that we may provide Compliance Checks and/or Triaging Information to a third party Recipient.

We recommend that you read the terms of use in full and print out a copy for your reference as they constitute our entire contract with you.

 

Introduction

www.legl.com and www.crowdjustice.com each a “site” and together “the sites”) are trading names of and operated by The Justice Platform Ltd (“Legl”, “we”, “us”, “ours” as appropriate).  

These triaging, payment and compliance  terms (the “Terms”) and the website terms (the "Website Terms") govern your use of the Payment System and/or submission of information via the sites in order that we may provide Compliance Checks and/or Triaging Information to a third party Recipient. By using the Payment System and/or providing your information for these purposes, you agree to these Terms and the Website Terms. Please read them carefully. We recommend that you print or save a copy of these Terms for future reference. To the extent there is any conflict between these Terms and the Website Terms, these Terms will prevail.

We may make changes to these Terms at any time by posting a copy of them on the site, or, where appropriate, sending you an email setting out details of the modified Terms. Any changes will apply to you seven days after the date of our email to you or the date on which we post the modified terms on the site, whichever is the earlier. 

If you continue to use the Payment System and/or provide information via the site(s) in order that we can provide Compliance Checks and/or Triaging Information to a third party Recipient (as applicable) after that period has expired, it means that you accept any such changes. You should ensure that you refresh your browser each time you use the site to review the latest version of these Terms.

These Terms and the Website Terms should be read in conjunction with our privacy policy, which you can read here ("Privacy Policy"). By agreeing to these Terms you also confirm that you accept the Privacy Policy and you agree to the way we may handle your personal information under the Privacy Policy. 

 

Definitions

In these Terms we refer to a “Matter” as the legal matter in respect of which you are making a Payment a “Case Page” as any page on our sites setting out information on a Matter (where applicable); a “Payee” as the legal person making payment via the Payment System; and a “Recipient” as the firm or legal services provider receiving Payments. “Payments” are the funds paid by Payees in relation to a Matter and a “Payment Page” is the online page on which you make a Payment. 

 

Your Responsibilities  

You are not a client of Legl for the purposes of the Matter. Furthermore, for the avoidance of doubt, submitting information in relation to Compliance Checks or Triaging Information, and/or making a Payment via the Payment System, is not determinative of your status as a client of the Recipient. You should therefore ensure that appropriate contractual arrangements are in place between you and the Recipient prior to making a Payment via the Payment System or submitting information in relation to a Compliance Check or the provision to the Recipient of Triaging Information. 

You are solely responsible for obtaining all the information you deem relevant about the Matter, if applicable, and your rights in relation to the Payment and/or the Matter.  

Legl does not actively edit, verify content or exercise editorial control over Case Pages published on the site and you should not rely solely on the information set out on a Case Page for the purposes of understanding the nature of the Matter or your rights in relation thereto. 

You are also solely responsible for verifying that the amount that you are paying via the Payment System is correct. Legl takes no steps to verify that the amount is correct, nor does it take any steps to investigate the use of Payment once the relevant funds have been transferred to the Recipient. All Payments are made at your sole discretion and risk.

 

Payment 

Your information

Legl will be provided with access to and/or receive the information required to contact you for the purposes of notifying you of a Payment request from a Recipient, where applicable, or alternatively you will provide Legl with contact information when you use the Payment System. This information will include your name and your email address. 

This information will be used for the purposes of, among other things:(i) notifying you via email of the Recipient's request for you to make Payment (where applicable); (ii) providing you with the relevant information required to submit the Payment, including (without limitation), details of the amount payable and a link to the Payment System; and (iii) providing you with confirmation that Payment has been made. 

Legl may also collect certain additional information about you when you access and use the Payment System, including your postcode, which will be used in connection with the processing of your Payment.

The Recipient is responsible for complying with all applicable data protection legislation in connection with the collection of your data and the transfer of your data to us. Any data that we hold and process about you will be managed in accordance with applicable data protection legislation and our Privacy Policy, further details of which may be found in the "Privacy" section of these Terms below.   

We will share information about your payment, including your name, email address, date of payment and payment amount, with the Recipient. 

 

Access to the Payment System 

As part of the email communication we send to you regarding the Recipient's request for you to make Payment (if applicable), you may be provided with a link and log-in details which you may use to access the Payment System. As part of this process, you will be requested to create a password which you will need to enter each time you wish to access the Payment System.  

You should not share your log-in details with anyone and should take sensible steps to ensure they remain private.

For the avoidance of doubt, certain Payment Pages are not password protected and do not require log-in details. 

If we suspect any fraudulent, criminal or improper activity is being carried out via the Payment System, in addition to terminating your access to or use of the Payment System and the associated services in accordance with these Terms, we may report or disclose information about you and/or your use of the Payment System and associated services to relevant law enforcement, at our sole discretion and without notice to you.

Your Payment will be processed by Stripe. Please see Stripe's Terms for the terms that will apply to the payments you make using the Stripe service. Once your Payment has been processed by Stripe, it may not be cancelled, refunded or recovered. This does not affect your statutory or legal rights. Should you wish to enquire about cancelling or obtaining a refund in respect of all or a part of your Payment, you will need to contact the Recipient directly. Legl is unable to process such requests. 

You acknowledge that all information you provide to us and via Stripe is true and accurate.

By making a Payment, you represent, warrant and undertake on a continuous basis to Legl that the payment of any funds used for such Payment will not result in a breach of applicable law. We reserve the right to cancel any Payments made via the Payment System without notice should we in our sole discretion suspect or determine that you have breached applicable law or any of these Terms (or pose any risk of doing so). We will not be liable to you for any losses that you suffer or incur as a result of us doing so.

On the successful processing of a Payment, funds go directly to the Recipient. 

 

Compliance Checks and Triaging

Compliance Checks

As part of our service, should you expressly agree to this, we may use your personal data to provide the Recipient with Compliance Checks. 

In order to do this, you will submit additional personal data via the site which will be processed by a third party provider engaged by Legl, currently Onfido. This will include your name, address, ID documentation, and in some cases, biometric data (i.e., a photo).

Either upon request by the Recipient or when Legl (or any of our engaged third party service providers) no longer needs to process this personal data (whichever is earlier), Legl will (a) cease all use of this personal data; and (b) destroy this personal data (unless storage of any such personal data is required by applicable law, including any applicable privacy laws).

Legl does collect information about whether you have passed these anti-money laundering checks, as well as detailed information in respect of these checks, and provides this information to the Recipient on request. 

You acknowledge that all information you provide via the site in relation to Compliance Checks is true and accurate.

 

Triaging

As part of our service, should you expressly agree to this, we may use your personal data to provide the Recipient with Triaging Information. 

In order to do this, you will submit additional personal data via the site which will be processed by a third party provider engaged by Legl, currently Typeform. This will include any information requested by the Recipient to determine your eligibility or suitability in respect of joining a given Matter. 

Either upon request by the Recipient or when Legl (or any of our engaged third party service providers) no longer needs to process this personal data (whichever is earlier), Legl will (a) cease all use of this personal data; and (b) destroy this personal data (unless storage of any such personal data is required by applicable law, including any applicable privacy laws). 

Legl does collect your answers to the eligibility questions, as well as information about whether you have passed the eligibility assessment, and provides this Triaging Information to the Recipient. 

You acknowledge that all information you provide via the site in relation to the provision to the Recipient of Triaging Information is true and accurate.

 

General

Content

All of the content used by Legl (including text, databases, graphics, videos and software) is owned by (and all copyright, trademark and other intellectual property rights in that content shall at all times remained vested in) us or our licensors and is protected by UK and international copyright and other intellectual property laws.

We make our content available via the Payment System and the sites for your personal, non-commercial use. You may view the Payment System pages and content and the sites online and print a copy of these Terms for your records. You may not otherwise reproduce, modify, copy or distribute or use any of the content on our site without our prior written consent. 

 

Privacy

The information you provide to us in relation to, or for the purpose of: (i) your use of the Payment System; (ii) Compliance Checks; and/or (iii) Triaging Information,  may also be used for the purposes of sending you updates from the Recipient. Please email us at contact@legl.com if you do not wish to be kept informed. You may unsubscribe from updates at any time.

There may be circumstances where we are obliged by law to disclose information about you. In the event we are ordered by a court or tribunal to disclose information about Recipients or Payees, we may be obliged to provide information you have given us via the Payment System or that you have made available to us in connection with Compliance Checks or the provision to the Recipient of Triaging Information. We will make reasonable efforts to challenge any request or order that in our view is without legal merit. By using the Payment System and/or providing your information for these purposes, you agree that we may be obliged to make such a disclosure.

FURTHER TO SUCH AN ORDER FOR DISCLOSURE OR OTHERWISE, A COURT MAY ORDER YOU TO PAY ADDITIONAL FUNDS IN RELATION TO THE MATTER IN CONNECTION WITH WHICH YOU SUBMITTED A PAYMENT, AND SUCH ORDER MAY BE FOR AN AMOUNT EXCEEDING THE AMOUNT YOU ORIGINALLY PAID. TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL LEGL, ITS DIRECTORS, ADVISORS, EMPLOYEES, PARTNERS, SUPPLIERS OR CONTENT PROVIDERS BE LIABLE FOR ANY LOSS, INCLUDING CONSEQUENTIAL LOSS, OR FOR OTHER DAMAGES, HOWSOEVER CAUSED (INCLUDING DUE TO NEGLIGENCE OR MISREPRESENTATION) THAT MAY RESULT FROM ANY COSTS AWARD OR OTHER ORDER AGAINST YOU.

 

Termination

Legl reserves the right, at our sole discretion, to suspend or permanently deny your access to the Payment System and associated services, immediately and without notice, where you breach these Terms including where there is any actual or suspected fraudulent, criminal or improper use of the Payment System and associated services. Upon such termination, suspension or denial of access to the Payment System and associated services, we may decide to refuse to transfer funds in connection with a Payment to the Recipient where there has been a breach of these Terms and/or where there is any actual or suspected fraudulent, criminal or improper use of the Payment System. In such an instance, and subject to any relevant investigation we may undertake in relation to your case, we may authorise a refund to you.

 

Disclaimer and Limitation of Liability

You agree that your use of the Payment System and associated services are provided on an ‘as is’ and ‘as available’ basis, and that your use of the Payment System and associated services is at your sole risk. We cannot guarantee and shall not be liable to you for any loss or damage arising in relation to the performance or reliability of the Stripe online payment processing services.

Legl explicitly excludes any other conditions, guarantees, warranties or terms in relation to the Payment System or its associated services, to the extent permissible by law.

TO THE FULLEST EXTENT PERMISSIBLE BY LAW, IN NO EVENT WILL LEGL, ITS DIRECTORS, ADVISORS, EMPLOYEES, PARTNERS, SUPPLIERS OR CONTENT PROVIDERS BE LIABLE FOR ANY DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO (I) ANY DAMAGES RESULTING FROM YOUR ACCESS TO, USE OF, OR INABILITY TO ACCESS OR USE THE PAYMENT SYSTEM AND ASSOCIATED SERVICES; (II) FOR ANY LOST PROFITS, DATA LOSS, OR COST OF PROCUREMENT FOR SUBSTITUTE GOODS OR SERVICES; OR (III) FOR ANY CONDUCT OF, OR CONTENT OF, ANY USER OF THE PAYMENT SYSTEM OR THE SITES.

The administration of your Payment by Legl via the Payment System in no way implies Legl's endorsement of a Matter or verification of the content of a Case Page. Nor do the inclusion of links on a Case Page to other websites imply endorsement of those sites. For the avoidance of doubt, each user of the site acts on his/her own behalf at all time and does not act as our agent in any way.

We do not make any representations or warranties as to the truth, accuracy, quality or completeness of information provided in connection with the Payment System.

We cannot guarantee and shall not be liable to you for any loss or damage arising in relation to the performance or reliability of the Stripe online payment processing services.

We shall not be liable to you for any loss or damage arising in relation to the results of any compliance or eligibility checks performed by Onfido or Typeform, respectively, or any replacement third party provider from time to time. 

Nothing on the Payment System or in emails sent to Payees by Legl on the Recipient's behalf is, or should be construed as, legal advice. 

The decision as to whether to make a Payment in connection with a Matter using the Payment System is that of a user of the Payment System alone and Legl accepts no liability for the reliance of a user of the Payment System on any content contained in the Payment System. We cannot guarantee that a Recipient has provided information that is accurate, complete or true. Consequently, we make no recommendation or representations in relation to any Recipient, Case Page or Matter.

Legl also disclaims any liability resulting from any loss or damage suffered by any person as a result of any direct or indirect use of any of the information or content available via the Payment System.

 

Indemnity

You agree only to use the Payment System in accordance with these Terms. You agree that you will indemnify Legl, our directors and employees, for any damages, losses, costs and expenses, including reasonable legal fees we incur that arise out of any breach by you of these Terms or for any liability we incur as a result of the use of the Payment System by you and/or any other person that uses your account with your permission or as a result of your negligence.
